We operate an e-shop on the website www.bloominds.cz.

We process certain personal data in order to provide our services, sell goods, and operate our website.

The processing of personal data is governed in particular by Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) ("GDPR").

I. Processing of personal data

A. Processing of personal data when using the contact form

If you inquire about our products and services, we will work with the contact details you provide us, mainly through the inquiry form. These include: first name, last name, email address, phone number, your requirements regarding our products and services, and any other information you provide in the inquiry form or provide to us as part of further negotiations.

We will contact you via them to make further arrangements regarding goods and services.

This is processing based on Article 6(1)(b) of the GDPR – negotiating a contract or taking steps prior to entering into a contract at your request.

 

How long will we process personal data?

If we do not establish further cooperation, we will process your data for a maximum of 3 days from our last communication.

 

B.Processing of personal data in the case of a purchase

If you make a purchase from us, we will process the information you provide us with. This mainly includes billing information: first name, last name, address, telephone number, and email address. In the case of self-employed individuals or legal entities, we also process your company ID number and VAT number.

For what reason?

We need to process personal data in order to fulfill our contract—to deliver our goods or services to you. We will also use your contact details to communicate with you about the status of your order, or to address any complaints or queries you may have.

We will continue to process personal data in order to fulfill our legal obligations (mainly for accounting and tax purposes, or for handling complaints and other matters).

On what legal basis do we process personal data?

This processing is based on Article 6(1)(b) of the GDPR – performance of a contract – and Article 6(1)(c) of the GDPR – compliance with a legal obligation.

How long will we process personal data?

During the delivery of goods or provision of services and then for a period of 3 years from your last purchase and last provision of these services or delivery of goods, but no longer than until you revoke your consent to the processing of your personal data (for this purpose of processing).


C.Verification of reviews

If you have made a purchase from us and left a review, we can verify in our system (if possible) that you are indeed our customer and that the review relates to products and services that you have actually purchased.

For what reason?

Consumer protection regulations (in particular the Consumer Protection Act) require us to verify reviews in an appropriate manner if we communicate them as authentic (from our customers).

 

D.Newsletters (commercial communications)

If you subscribe to our newsletter or if you are a customer and have not opted out during your purchase, we will use your email address to send you our news.

On what legal grounds?

In the case of newsletter registration, processing is based on your consent, i.e. on Article 6(1)(a) of the GDPR. 

If you are a purchasing customer, this is permitted under Section 7(3) of Act No. 480/2004 Coll., on certain information society services, unless you have prohibited us from doing so at the time of purchase.

Consent is voluntary and can be revoked at any time.

How long will we process personal data?

2 years fromthe date of consent or last purchase.

E.Analytics

We also use information about your purchase (what you bought, when, under what conditions) for analytical purposes. Based on this data, we know what goods to buy, where to strengthen our services, where to "cut back," and what to expect economically in the future. In short, we need data to properly manage and develop our company.

We need data to manage and develop our company properly.

On what legal grounds?

This is processing based on Article 6(1)(f) of the GDPR – processing based on a so-called legitimate interest.

How long will we process personal data?

For a period of 12 months, after which we anonymize the data for these purposes or do not process it further.

 F. Analytics and ad targeting using contact information

If you have given us your consent on our toolbar, we also use your phone and email for analytics, tracking, and advertising targeting purposes, including through the use of (and linking to) Google tools.

This processing is based on your consent, i.e. on Article 6(1)(a) of the GDPR. Consent is voluntary and can be revoked at any time.

How long will we process personal data?

For a maximum period of 1 year, unless you extend or withdraw your consent.

 

II. Who has access to the data?

Your data will remain with us. However, we work with certain companies or other individuals who have access to your data because they help us run our e-shop. These are:

We process personal data within the European Union or within the framework of US tools that have joined the Data Privacy Framework program.

 

III. What else you should know 

Our company does not have a designated data protection officer.

In our company, decisions are not made on the basis of automated processing or profiling.

If you believe that we are not handling your data correctly, you have the right to file a complaint withthe Office for Personal Data Protection or take your claims to court.
